BASIC TRAINING COURSE INTRODUCTION

Overview

This Basic Training Course on Arbitration is designed to methodologically and comprehensively provide learners with basics of arbitration from a comparative perspective. With lectures prepared and delivered by prominent arbitration practitioners, the Course offers not only knowledge of both international and domestic arbitration, but also skills and practical tips for participants of arbitral proceedings. Upon successful completion of the Basic Training Course on Arbitration, learners will be recognised as VIART’s Associate.

Objective

Upon successful completion of the Course, learner will be equipped with:

  • Concept and principles of arbitration;
  • Flow of a regular arbitral proceeding;
  • Key participants in arbitral proceedings and their roles, rights and duties.
  • Skills and tips at different stages of an arbitral proceeding.

Syllabus

The Course covers the following main subjects:

  • Arbitration as a means of alternative dispute resolution; features, principles, and forms of arbitration;
  • Arbitration agreement and its elements; how to draft an effective arbitration agreement;
  • Arbitrators and Arbitral Tribunal – their power, duties, jurisdiction, ethical issues and challenges;
  • Conduct of arbitration and procedural issues;
  • Statements and evidence in arbitration;
  • Hearings;
  • Arbitral awards – Finality, annulment, recognition and enforcement.

The Course is suitable for lawyers, legal practitioners, and practitioners in other industries who wish to use or practice arbitration either as counsel, representative or arbitrator; and those who are interested in arbitration.

ADVANCED TRAINING COURSE INTRODUCTION

Overview

As the follow-up level of the Basic Training Course, this Advanced Training Course on Arbitration is designed to provide learners with in-depth knowledge on certain arbitration-related issues. More importantly, this Course focuses on practical skills for professional arbitration users and practitioners, with active learning method that allows learners to engage and gain better understanding. Upon successful completion of the Advance Training Course on Arbitration, learners will be recognised as VIART’s Member (mVIART).

Objectives

Upon successful completion of the Course, learner will be equipped with advanced knowledge and skills to handle various situations during different stages of an arbitral proceeding. Learners will be able to identify the core issues being faced and respective techniques for analysing and finding solution.

Syllabus

The Course covers the following main subjects:

  • Jurisdictional issues;
  • Case management;
  • Independence and impartiality – Challenges to arbitrator;
  • Evidence in arbitration
  • Oral advocacy at Hearings;
  • Multi-party arbitration;
  • Third-party funding.
