VIAC & VIART successfully organized two Foundation Training courses on “Skills for Dispute resolution through arbitration” in Hanoi and Ho Chi Minh City

In November, in order to provide businesses and lawyers with methodical and systematical approach to the knowledge and international practice of commercial arbitration, the Vietnam Institute for International Arbitration Research and Training (VIART) - a division of the Vietnam International Arbitration Center (VIAC), organized the first 02 training courses on “Arbitration skills for dispute resolution” (Basic module) on 4 – 6 November 2022 in Hanoi and on 11-13 November 2022 in Ho Chi Minh City. The training courses were established with the companionship of National Economics University, HCM University of Law, Vietnam Business Lawyers Club with the support of other organizations and companies including ADR Vietnam Chambers, HopDang's Chambers, Dzungsrt & Associates, IDVN Law firm, Vietnam International Law firm (VILAF - Hong Duc).

In his opening speech at the training course in Hanoi, Mr. Vu Anh Duong - Vice President cum Secretary General of VIAC shared that alternative dispute resolution methods (ADRs), especially commercial arbitration, are growing stronger with many great strides in recent years. In this regard, and with the support of VIAC – a leading arbitration organization with practical experience in arbitration, understanding of the arbitration market as well as a team of leading experts in different business fields, the Vietnam Institute for International Arbitration Research and Training (VIART/Institute of Arbitration) was officially established in April 2022. This is the successor of a solid foundation, with the available resources focusing on the promotion and development of ADRs in general and arbitration in particular in Vietnam.

Mr. Vu Anh Duong affirmed VIART’s mission to steer the development trend of the Vietnam’s arbitration market, reaching the international market through research and training activities. He also emphasized that VIART would become a trustworthy companion with individuals on their career paths in the field of arbitration as well as the general development of the community, contributing to the development of commercial arbitration in Vietnam.

On behalf of National Economics University (NEU)’s School Board of Directors, Assoc.Prof.PhD. Bui Huy Nhuong - Vice Principal shared that as a leading national university, NEU is very honored to become a partner in the implementation of the first arbitration and mediation training courses organized by VIAC’s divisions. Since Vietnam entered the period of extensive and comprehensive international integration, the awareness of the business and the lawyer community on arbitration has significantly increased while the arbitration market has flourished with several advantages for future development. Accompany with VIAC's support in the training activities, NEU also expects to witness significant changes and contribute to the development of arbitration and mediation in Vietnam.

In his opening speech at the training course in Ho Chi Minh City. Ho Chi Minh, PhD. Lawyer. Chau Viet Bac - Deputy Secretary General of VIAC emphasized the popularity of the use of arbitration for business and commercial dispute resolution. Mr. Chau Viet Bac also hoped that with the development trend of arbitration, the course organized by VIAC in collaboration with the Ho Chi Minh City University of Law would provide trainees with comprehensive knowledge which can be utilized in the trainees’ future legal profession.

Following the working session, besides expressing his delight at having the opportunity to cooperate with VIAC to organize this course, Assoc.Prof.PhD. Bui Xuan Hai - Deputy Secretary of the Party Committee, Vice Principal of Ho Chi Minh City University of Law (HCMCUL) also affirmed that arbitration, as a dispute resolution, would strongly develop in the current integration period. Assoc.Prof.PhD. Bui Xuan Hai highly appreciated VIAC’s thorough preparation for the course content, he also expressed his confidence on the practical knowledge and experience that the course could provide its trainees through the lessons.

Representative of VIART, Assoc.Prof.PhD. Pham Duy Nghia - Director of the Vietnam Institute for International Arbitration Research and Training (VIART) under VIAC also affirmed that VIART focuses on training high-quality human resources in the field of arbitration, developing core factors, thereby building a community of professional arbitration users and practitioners following VIART's career development pathway. On behalf of the Institute, Mr. Nghia also thanked the National Economics University and the Ho Chi Minh City University of Law who have accompanied the Institute in the first two training courses and hopes that for further close partnership in VIART's general training activities in the future.

Training courses in Hanoi and Ho Chi Minh City welcomed more than 100 trainees who are lawyers, inhouse counsel, lecturers, and excellent students along with the attendance of 14 mentors and facilitators who are reputable and highly specialized experts with many years of experience in alternative dispute resolution (ADRs), arbitration proceedings, as well as in teaching specialized training courses for lawyers and businesses.

In addition to listening to shared knowledge, experience, and practice in the process of arbitration, trainees also experienced roleplay in the mock arbitration session. Groups of trainees had very lively and active discussions on issues in arbitration such as arbitration agreements, sessions, evidence, etc. and listened to the feedback, comments as well as useful advice from mentors.

At the end of the training course, VIAC and VIART hope that the trainees have had good experiences, updated knowledge and new skills in arbitration, benefiting their research and professional development. With the completion of the training course and the final exam, participants will be certified to the first level of membership of the Institute - Associates. VIAC and VIART hope that all the trainees will continue to pursue the development pathway of the Institute and together with the Institute building a community of professional arbitration users and practitioners in Vietnam in the near future.

Training activities at the Vietnam Institute for International Arbitration Research and Training (VIART)

In addition to research activities, along with training activities, VIART wishes to popularize arbitration knowledge, focus on developing the human factor, all in order to build a community of professional arbitration users and practitioners; thereby, aiming to orientating the development trend of the arbitration as well as Alternative Dispute Resolutions (ADRs) market in Vietnam. Accordingly, VIART in the coming time will continue to organize annual Arbitration and ADRs training courses with systematic and methodical training content on knowledge of arbitration matters such as training about arbitration basic skills, mediation basic skills, arbitrators’ skills, arbitration litigation skills for lawyers, mediation participation skills for lawyers and businesses, mediators’ skills, etc.

The training courses are organized to suit a variety of target groups such as legal personnel, legal professionals, lawyers, in-house counsel, jurists, lecturers, students and other persons with an interest in arbitration. With three levels of specialization in arbitration and specialized/intensive courses as well as the partnership of training institutions, organizations and associations with the same function and objectives, VIART hopes to accompany trainees on the path of development, towards using and practicing professional arbitration.
